Welcome to Dash Deliveries. These Terms and Conditions ("Terms") govern your access to and use of the Dash platform, including food delivery, product delivery, bookings, and all related services (collectively "Services").

By accessing or using our Services you confirm that:

• You are at least 18 years of age and legally capable of entering a binding agreement.
• You have read, understood, and agree to be bound by these Terms in full.

Some features of the Dash platform require you to create an account. When registering:

• You are solely responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately at hello@dashdeliveries.com if you suspect any unauthorised access to your account.

When placing an order through Dash, you agree to the following:

• All items and prices are subject to vendor availability. Prices displayed are inclusive of any applicable commissions.
• Commissions of 8%-10% are applied to food and grocery items. Certain product categories carry no additional commission.
• You agree to provide accurate delivery information. Incorrect details that lead to failed deliveries may result in forfeited orders.
• Orders are subject to vendor confirmation.

Delivery is available within our service zones. Zone availability, fees, and estimated times are displayed at checkout before you confirm your order.

• Delivery fees are calculated based on your delivery zone and distance from the vendor. These fees are shown transparently before order confirmation.
• Estimated delivery times are indicative only and may vary due to traffic, weather, or high demand periods.
• GPS-assisted delivery: When you share your location, the platform may calculate a more precise delivery fee based on your actual distance from the nearest hub.
• Pickup orders are the customer's responsibility once order is placed from the vendor.

Dash accepts a variety of payment methods to make ordering as convenient as possible:

• M-Pesa: Pay via Lipa na M-Pesa using Dash's registered till.
• Cash on Delivery: Available for eligible orders.

Cancellation Policy:

• You may cancel an order before it is confirmed by the vendor at no charge.
• Once a vendor has confirmed and begun preparing your order, cancellations may not be possible.

Refunds:

• Refunds are processed in cases of: incorrect items delivered, undelivered orders confirmed by our records, duplicate payments, or platform errors.
• Quality complaints regarding vendor-prepared items should be raised directly with the vendor. Dash may facilitate a resolution at its discretion.

Your privacy is important to us. By using Dash, you consent to the collection and processing of personal data as described below:

• Information we collect: Name, phone number, email address, delivery address, GPS location (if shared), order history, and payment method details.
• How we use it: To process orders, facilitate delivery, send order updates, improve our Services, and comply with legal obligations.
• Who we share it with: Vendor partners (for order fulfilment), delivery personnel and payment processors.
• GPS Data: Location data shared during checkout is used solely to calculate delivery distance and is stored with your order record for fulfilment and support purposes.
• Data retention: We retain your data as long as your account is active or as needed to provide Services. You may request deletion of your account and associated data.

Your responsibilities as a user:

• Provide accurate, honest information when placing orders and registering.
• Not use the platform for any unlawful, fraudulent, or malicious purpose.
• Not harass, abuse, or threaten our delivery personnel, vendor staff, or other users.
• Not use another person's account without their explicit consent.

Dash's liability is limited as follows:

• Dash acts as a technology intermediary and is not responsible for the quality, safety, legality, or fitness of items sold by vendors.
• We are not liable for delivery delays caused by traffic, weather, civil unrest, or other circumstances beyond our control.
• Our total liability to you shall not exceed the total value of the order(s) in dispute.
